No. 367 IN PURSUANCE OF AN ACT OF CONGRESS OF THE UNITED STATES OF AMERICA, ENTITLED, 'AN ACT CONCERNING THE REGISTERING AND RECORDING OF SHIPS OR VESSELS,' THOMAS H. MERRY OF THE CITY, COUNTY, AND STATE OF NEW YORK, MARINER, having taken or subscribed the Oath required by the said act, and having sworn that I TOGETHER WITH WILLIAM HILL OF THE SAID CITY MERCHANT ARE THE only owners of the ship or vessel called the AMERICAN EAGLE of NEW YORK whereof THE SAID THOMAS H. MERRY is at present master, and is a citizen of the UNITED STATES. and that the said ship or vessel was BUILT AT HAVERHILL STATE OF MASSACHUSETTS IN THE YEAR 1795 AS PER REGISTER NO. 126 ISSUED AT THIS PORTION THE FIRST DAY OF MAY LAST NOW GIVEN UP THE PROPERTY BEING CHANGED IN PART AND MICHAEL HODGE SURVEYORS having certified that the said ship or vessel has TWO decks and THREE masts and that her length is EIGHTY THREE FEET SEVEN INCHES her breadth TWENTY FIVE FEET her depth TWELVE FEET SIX INCHES and that she measures TWO HUNDRED TWENTY FIVE & 57/95 tons; that she is A SQUARE STERN SHIP has QUARTER BARGES, and AN EAGLES head; and the said THOMAS H. MERRY having agreed to the description and admeasurements above specified, and sufficient security having been given according to the said act, the said SHIP has been duly registered at the port of NEW YORK GIVEN under OUR HANDS and SEALS at the port of NEW YORK this TWENTY EIGHTH day of DECEMBER in the YEAR ONE THOUSAND EIGHT HUNDRED and TWO.'

It describes his activities as inspector of artillery and his involvement in the founding of the military academy at West Point. Tousard's visits to many of the United States' military coastal installations are well described. The letter book contains copies of Tousard's correspondence with many prominent military officers and government officials including: Colonel Timothy Pickering, Stephen Decatur, James McHenry, and Secretary of War Henry Knox.
